The following definitions apply in these Terms:
“Accidental Damage Deposit” means a deposit of £500 to cover any damage to Bryn Benar.
“Booking Confirmation” means the confirmation of booking provided to you when a booking has been accepted.
“Booking Deposit” means a deposit of 25% of the total Rental Price.
“Booking Form” means the accommodation booking form completed by you.
“Bryn Benar” means the holiday accommodation as detailed in your booking.
“Guest” means you and each person included within your booking.
“Owner” means the owner of Bryn Benar, being Antonia Gould (also referred to as “we” and “us” in these Terms).
“Rental Price” means the total holiday accommodation cost to stay at Bryn Benar which includes any extras selected at the time of booking.
“Start Date” means the first day of the rental period as specified in your Booking Confirmation.
“Terms” means these terms and conditions.
“You” means the lead person making the booking with us to stay at Bryn Benar.
Bookings cannot be accepted from persons under 25 years of age.
Bryn Benar is let on the basis that it is strictly for holiday use only and no rights to remain or occupy the house shall exist for you or anyone in your party.
No bookings are valid until confirmed by us in writing and the Booking Deposit paid and received for your stay. A booking is made by completing and submitting the Booking Form and paying the Booking Deposit. Once we have received the Booking Form and the Booking Deposit and we have accepted your booking, we will send you a Booking Confirmation. At this point a binding contract exists.
Bryn Benar is meant to be used for the purposes of a holiday and certain group bookings, including stag and hen parties, will not be allowed to book unless prior agreement with the Owner is made and a larger Accidental Damage Deposit may be payable.
Upon receiving your Booking Confirmation, we advise you to check through all the details and notify us within 7 days of any errors. After this time, we reserve the right to charge an administration fee of £25 to correct any errors made by you (for example, changing the lead booker and/or the dates of your stay).
Once a booking is confirmed, it cannot be changed by you unless agreed by the Owner.
All bookings require an administrative charge of £25.
If the booking is made more than 9 weeks before the Start Date then 25% of the full rental price is payable.
You must pay the balance of the rental fee in full and the Accidental Damage Deposit due to the Owner at least 9 weeks before the Start Date.
If you fail to pay the balance of the Rental Price when due and/or the Accidental Damage Deposit, we may (in our sole discretion) cancel the booking and any Booking Deposit will be forfeited. In such circumstances, you shall have no claim against us for compensation or reimbursement whatsoever.
If the booking is made less than 9 weeks before the Start Date, then the full Rental Price and Accidental Damage Deposit are payable at the time of booking.
If, for any reason, Bryn Benar is not available to let on the date(s) booked, we will refund all monies paid by you in advance and you will have no further claim against us. We will not be liable for any costs incurred by you for any alternative accommodation due to our cancellation.
All payments must be made by electronic bank transfer, account details will be found on the Booking Confirmation.
If you wish to cancel or change your booking for any reason you must advise us immediately in writing by email at: [email protected].
If you cancel the booking more than 9 weeks before the Start Date, the Owner shall be entitled to retain a £25 administration fee but the Owner will refund all other sums paid by you.
If you cancel the booking by giving us 9 weeks’ or less notice the following provisions will apply:
If a refund of the Booking Deposit or other sums is due to you on cancellation, we will aim to return the applicable amount within 10 working days of the date of cancellation.
If there has been a substantial breach of any of your obligations under these Terms, we may end this contract and may ask all Guests to leave the property prior to the end of the rental period (if you are in occupation). Under such circumstances any monies paid in advance by you shall be forfeited.
It is a requirement when booking Bryn Benar to pay an Accidental Damage Deposit of £500 which is payable with the final balance of the Rental Price, 9 weeks before your arrival.
The Accidental Damage Deposit will be held by the Owner to cover any breakages or damage to the property that requires rectification during or after your departure and to cover the reasonable costs of miscellaneous repairs to and/or replacement of and/or additional cleaning of furnishings, kitchen equipment, crockery, glass, keys, beddings and towels damaged or soiled otherwise than by usual wear and tear during the period of the booking by you and other Guests.
If you lose the house keys a charge of £50 will be incurred per key and taken off your Accidental Damage Deposit refund.
Where any costs to rectify damage to the property exceed the Accidental Damage Deposit, you agree to pay such excess to the Owner promptly and in any event within 14 days of being notified.
The balance of the Accidental Damage Deposit will be returned to you within 10 working days of the departure date, less any deductions made for the cost of remedying any damage.
You and all Guests will only use Bryn Benar for the purpose of a holiday let, and you acknowledge that the right granted to stay in Bryn Benar is not an assured tenancy and no statutory periodic tenancy will arise.
You will ensure that all Guests will act responsibly and carefully whilst at Bryn Benar, abiding by the specific house rules within these Terms. You will leave the property and all things in or at it, in the same state of repair and cleanliness as at the Start Date.
You will report to the Owner any damage or breakages made during the holiday occupancy and pay for any damage (fair wear and tear is accepted).
Bryn Benar is strictly a non-smoking and non-vaping house.
You must not allow more than the maximum number of people or pets to stay at Bryn Benar as agreed in the Booking Confirmation unless otherwise agreed with the Owner in writing. No overnight Guests are permitted without the Owner’s prior consent.
At all times you must comply with any applicable laws or Government guidance and ensure that no Guest or pet does anything which is illegal, or may cause unreasonable damage, noise, behaviour or disturbance.
Guests can only enter Bryn Benar from the Start Date and time on the Booking Confirmation and will leave Bryn Benar before the end of the stated departure date and time.
All Guests must secure the property (including all windows and doors) whenever leaving the property.
The Owner will be entitled to make a reasonable charge to you where a Guest has failed to comply with these responsibilities. In serious cases, Guests may have to leave the Property early without any compensation or refund.
Bryn Benar allows up to two well behaved dogs to stay with prior agreement with the Owner. At the time of booking please confirm the breed of dog(s) that you wish to bring. An additional charge of £50 is payable per dog per week to allow for additional cleaning. No other pets are permitted without the Owner’s prior written consent.
Dogs must be under strict control at all times whilst in Bryn Benar and are not allowed upstairs or on any furnishings and hair must be cleared up before departing.
Dogs are not allowed to be left in the property on their own.
Guests must ensure that their pets are free from parasites and fleas before they occupy the property, failure to do so may incur subsequent charges.
Puppies (under 1 year old) must be declared to the Owner at the time of booking and authorised by the Owner.
The Guest must bring the dog’s bed or basket.
You will be liable for any damages caused by any Guest’s dog. Any damage is to be reported to the Owner immediately.
Assistance dogs are allowed in Bryn Benar. We may require evidence of registration or other information from you at point of booking.
Dogs are not permitted to defecate in the grounds where children may play. All dog mess must be cleared up in the garden, any mess not cleared up will result in £50 charge being taken off your Accidental Damage Deposit.
Pets other than dogs may be allowed at the Owner’s discretion. This must be approved in writing prior to making a booking.
We do not transfer your personal data outside the UK.
If, during the course of business, we engage third parties whose processing of your personal data will involve a transfer of data outside UK, we will ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

Bryn Benar does have an electric car charger. This is available for use solely by guests.
You must use only the designated charging point and manufacturer approved cables for charging your vehicle.
Guests are not permitted to charge their car(s) by any other method than via the Owner installed Zappi-222TB 22KW charger.
The Owner reserves the right to refuse to allow electric vehicles to be charged if they do not believe that it is safe to do so.
The driveway at Bryn Benar can accommodate three cars. Guests must only park in the drive way adjacent to the Bryn Benar sign and letterbox. You must park within the kerb line and not obstruct any public highways or access to neighbouring properties.
If you have any complaints during your stay at Bryn Benar, it must be reported to us as soon as possible during your stay to allow us the opportunity to carry out any assessments or corrective actions. We will do our best to resolve your complaint where possible.
If we are denied the opportunity to assess the issue or carry out any remedial actions then you will be deemed to have waived any rights to any compensation or any other applicable remedy available to you.
If you have any complaints following your stay, please contact us as soon as possible.
Should you leave any of your personal belongings behind, you should advise us as soon as possible to enable us to search the house. This may not be possible if there are other customers staying at the house. You will reimburse us for all postage, packing and other costs prior to such items being sent to you. Where items have been left but have not been claimed within 30 days of departure, we reserve the right to dispose of these items.
Our contract with you is made on the basis that the property is to be occupied by the Guests for a holiday (pursuant to paragraph 9, Schedule 1 of the Housing Act 1988).
When making the booking you acknowledge on behalf of all Guests that the tenancy granted by these Terms is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.
Once you have made a booking there is no cooling off period as the contract you have made is for accommodations services for a specific period of performance.
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
Nothing in these Terms limits our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence.
These Terms are governed by English law and you can bring legal proceedings in respect of your booking in the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.
All belongings and vehicles (together with contents) owned by Guests are left at the house entirely at your own risk. We accept no liability whatsoever to you or any third party for any loss, damage or injury howsoever caused to you, your Guests or your belongings during your stay at Bryn Benar except to the extent that such loss, damage or injury is caused by our negligence or wilful default.
We will not be in breach of these Terms or otherwise liable to you or any third party arising from any circumstances beyond our reasonable control including without limitation, flood, fire, explosion, accident, strikes, war, threat of war, natural or nuclear disaster, no availability of transport services, interruption to services/utilities and all similar events outside our control.
Your contact details will not be passed onto any third party without your approval. We will only use your personal information as set out in our Privacy Policy.
